AMERICANS need to UNDERSTAND how AMENDMENT XIV is being MISCONSTRUED.

Is Amendment XIV ratified in 1868, being followed?
This Constitutional amendment in section 2, directs that, “ Representatives shall be apportioned among the several States according to their respective numbers, … ” meaning adjusting the size of the House according to what their state population is, but not more than one per 30,000. From 1790 to 1910 the precedent had been established and continued; that every ten years, a census was taken, and the number of Representatives in the House was increased accordingly with the increase of the population. Pointing out that enlarging the House with the increasing population, set the precedent. This includes the census of 1870, after the Amendment was ratified, through 1910, or a total of 40 years after ratification of Amendment XIV.

HISTORY OF FACTS ON HOW AMENDMENT XIV WAS TO BE INTERPRETED. From the1870 to the 1910 census, the House of Representatives enlarged from 293 to 435 elected officials, or just over 67% in 40 years, with the increase in population from 38,558,371 to 92,228,496 people. The nation continued enlarging the House following the passage of Amendment XIV in 1868 until 1913, when a law passed by Congress was accepted as effective, contrary to the Constitution, to no longer increase the size of the House of Representatives. The American people and the Supreme Court Justices have allowed this congressional law to trump the constitution, and to remain on the books to ‘the people’s’ detriment.

TODAYS DISTORTED INTERPRETATION.   Ever since 1913, the constitutional directive of adjusting the size of the House of Representatives has stopped. Now days we are just increasing the size of our Congressional Districts, with some Districts already over 900,000 people per Representative. Without enlarging the House, we are simply re-distributing the same number of Representatives around the nation with each new census. These 435 Representatives move decade after decade according to the growth and shift of the population. And this is all done under the new interpretation and for the appearance of fulfilling the requirement “Representatives shall be apportioned among the several States according to their respective numbers” (Amend. XIV Sec.2. ).
Just re-apportioning the same number of Representatives to different areas around the Nation, after each census, brings about a completely different interpretation and even reversal of the founders design and intent.
We need people in congress that have the understanding and fortitude to recognize, create, pass, and enforce, only those laws which are “made in Pursuance”, (Article VI. Par.2) of our Constitution. In this matter, Congress should have stood to defend the “made in Pursuance” clause and the right of the People, to have increasing representation in a growing populace to properly police and control their expanding Government, as the founders designed.

CONGRESS FAILED THE PEOPLE. Congress should have realized that they did not have the power to go contrary to the Supreme Law of the land, our Constitution. Congress should have rejected the Bill for stopping the growth in the House of Representatives, resulting in passage of The Permanent Apportionment Act of June 18, 1929, (Public Law 71st Congress Ch.28 Sec.22), fixing the number in the House of Representatives at 435, from the 1910 census. Locking the size of the House is NOT in Pursuance of Our Constitution, as stated in Amendment XIV. August 11th 2011, makes it 100 years since the House of Representatives has been enlarged. These types of public Laws are responsible for the increasingly diminishing power we have over our government.
It is one thing to decree on how many People there should be on the floor of the House and quite another to prevent the whole House of Representatives from any further increase.
It is un-Constitutional, that with each new census we just redistribute the existing House members through out the nation, forcing Congressional Districts continuous growth, while the people’s voice and power over their government diminishes.

PUBLIC’S DEMINISHING CONTROL. With every new census we have been denied more and more Representatives for the people. Since Public Law 62-5 was passed, we have increased over 200 million people in our U.S. population. Read Public Law 62-5 attached, and see how 100 years ago, the 435 Representatives of the House were to be distributed. With each new generation, Americans have had less and less power over their government. This current neglect in congress prevents the needed amount of Representatives to oversee and police our ever-growing National government. With the Federal Government’s expanding programs, we are becoming slaves in the land of the free. We are giving up our controls over the people’s government.
This void in the people’s control over government, distances the people from their government, and breeds apathy, disrespect, and discontentment for government followed by a lack of confidence in the people to govern.

Let us contact our representatives in Congress, and demand that they quit with the new interpretation of failing to enlarge, but rather juggling our 435 Representatives in the House; and just return to the original intent of the Constitution and enlarge the House of Representatives as the Founders intended. Let us implement the controls the Founders designed and enjoy their dream of ‘Government by the Citizens of America.’
