It should be clear that a Government of the people, by the people and for the people no longer exists. We the people are subjects of the Federal Government without an established means of protecting or re-establishing our once cherished individual and State sovereignty.

The ObamaCare opinion by Chief Justice Roberts gives the Federal Government unlimited power over the individual. The constitution gives Congress the power to lay and collect taxes in Article I, Section 8 so the key words I believe in the opinion are “And Congress’s choice of language—stating that individuals “shall” obtain insurance or pay a “penalty”—does not require reading §5000A as punishing unlawful conduct. It may also be read as imposing a tax on those who go without insurance.” In other words the mandate is not a mandate and the penalty for not buying insurance is not a penalty for that would be unconstitutional, it is just a tax on those who didn’t happen to buy insurance. Congress may now and forever more substitute any noun in the two locations of “insurance” and it will be constitutional according to Roberts. For example the sentences could have been written with the words insurance replaced by “a Chevy Volt”. And of course there is no limit to the size of the tax so it could be the price of a Chevy Volt. I guess when we conservatives control Congress we can tax everybody who didn’t happen to buy a gun.

 Our founding fathers fought wars and changed governments over acts no less consequential. The drip drip of sovereignty lost has been ongoing for more than a century but it should be obvious that we are now at a critical inflection point in the history of the United States. It has been thrown in our face that we the people are not sovereign in the eyes of the courts, we can be forced by the Federal Government to spend our money for objects we do not want or by force of law they will take our money from us. We the people who created the courts when creating the Constitution have been betrayed by these courts and the power of the people so often mentioned by our founders has been taken from us and given to the Federal Government.

TEA Party Don't Tread On MeThere will be much written I hope in the next few months about how we and State Governments can correct this usurpation of power. Clearly voting out of office those that created this “tax” is a requirement but more must be done to re-establish our individual and State sovereignty. We must pay attention and coalesce around a plan of action for the next decision could be far worse if this one is not adequately countered.
