Creditors to fight Detroit insolvency claim

Detroit— The city of Detroit filed the largest municipal bankruptcy case in U.S. history Thursday, culminating a decades-long slide that transformed the nation’s iconic industrial town into a model of urban decline crippled by population loss, a dwindling tax base and financial problems.

Gov. Rick Snyder justified approving the historic filing by reciting a litany of the city’s ills, including more than $18 billion in debt, maxed-out tax rates, the highest murder rate in 40 years, 78,000 abandoned buildings and a half-century of residential flight. He said the city failed to provide basic services to residents or pay creditors.

The filing, which has broad implications for the nation’s municipal bond market and sanctity of public pension funds, was met with outrage, disappointment and a vow to fight. Some creditors adopted a war stance, threatening a prolonged battle. Others accused Emergency Manager Kevyn Orr of failing to negotiate in good faith — an essential requirement for approval of a bankruptcy petition — during his month-long push to secure concessions from creditors, including deep cuts to pensions.

“It’s war,” said George Orzech, chairman of the city’s Police and Fire pension fund.

Detroit bankruptcy filing puts Obama in awkward spot

When Detroit on Thursday became the largest U.S. city to file for bankruptcy, it punctured a major narrative that was key to President Obama’s re-election: that his auto bailout would help resuscitate the Motor City’s battered economy and inject life into an area unable to shake hard times.

Facing $18.5 billion in long-term debt, Detroit is now turning to the federal courts for help, hardly matching the rosy portrait painted by the president in recent months.

On the campaign trail, particularly in the Midwestern states dependent on the auto sector, Obama trumpeted his cash infusion to major American car companies as part of his populist pitch to blue-collar voters.

“I wasn’t going to let Detroit go bankrupt. Or Toledo go bankrupt. Or Lordstown go bankrupt. I bet on American workers,” Obama said in the final sprint to November’s election.

And Obama and his campaign demonized Republican presidential candidate Mitt Romney for a New York Times op-ed headlined, “Let Detroit Go Bankrupt.”

Al Qaeda Rebels Kill Free Syrian Army Commander

Assassination triggers third front in Syrian civil war

A key commander of the U.S.-backed Free Syrian Army was killed recently by Syria’s al Qaeda rebels, a sign the opposition to the Bashar al-Assad regime is fracturing and Islamist rebels are on the rise.

Kamal Hamami, the FSA commander, was killed as he went to a meeting of al Qaeda-backed rebels to discuss joint operations against the Syrian army, a U.S. official said, confirming Middle East press reports.

Hamami had opposed the al Qaeda-linked rebels and said there was no place for them within the opposition forces.
He was killed in Latakia province, in the northern part of the country near the Turkish border, a known stronghold of Islamist rebels.

Judge Hyatt Ruled In Favor of Colorado Recall Efforts

Recall Election Date Officially Set

Today (July 18, 2013), Denver Chief District Judge Robert Hyatt ruled against the legal challenges to the Colorado recall efforts and allowed for the recalls to continue against Senator John Morse and Angela Giron.

Citing a 1997 Court case, Judge Hyatt said “the court finds that the recall process involves fundamental rights of republican form of government which the people have reserved to themselves”.

Judge Hyatt also declared that “the court gives great weight to the fact that the proponents for the recalls unquestionably made a good faith effort to comply with all aspects of Colorado Law regarding recalls”.

NLRB General Counsel Nominee’s Union Gave Nearly $1 Million To Lawmakers In June

One day after the constitutionally-challenged NLRB member Richard Griffin was supposedly ousted as part of Senate Republicans’ giving in to Harry Reid’s threat to use the “nuclear option,” Griffin was nominated to become the NLRB’s general counsel. One might wonder, how many were in on the deal before it was made and at what price?

The surprise announcement of Griffin’s new nomination was made on the heels of Barack Obama having nominated, based on the advice of AFL-CIO boss Richard Trumka, two new members to the NLRB–one of whom is a recently retired associate general counsel for the AFL-CIO.

As the former general counsel of the International Union of Operating Engineers, Richard Griffin’s union has close ties with NLRB chairman Mark Pearce, whose former Buffalo, NY law firm once had the IOUE as a client.

However, what is more curious is the abnormally high amount of political expenditures the IUOE’s political action committee spent on lawmakers in the month of June.

American Hero Larry Grathwohl Dead

“We have just learned that Larry Grathwohl was found dead in his Cincinnati apartment,” colleague Doug Hagmann wrote in an email to Canada Free Press (CFP) this evening.
“Many of us are in shock tonight,” Tina Trent wrote in her blog.

The lifelong courage of Larry Grathwohl brought him legions of fans, many of whom will be heartbroken upon hearing this news.

It was Grathwohl who awakened America to the inherent dangers of Barack Obama in the run up to the 2008 presidential election when he described a meeting he attended where Bill Ayers and Weather Underground members talked openly about how they would have to murder an estimated 25 million people following the revolution they were then attempting to foment.

President Obama has settled on two new appointments to the National Labor Relations Board after consulting with AFL-CIO President Richard Trumka.

Obama tapped Nancy Schiffer and Kent Hirozawa for the NLRB. Schiffer is the associate general counsel at the AFL-CIO and Hirozawa is the chief counsel to NLRB Chairman Gaston Pearce.

But Sen. Mike Lee, R-Utah, opposed the deal, suggesting that the Republicans emerged from this battle weaker politically than they would have been had they refused to back down, even if Reid carried through with the nuclear option, something Lee didn't think he would do.

"If you move in this direction, you may end up giving up what you would lose if they did in fact go nuclear," Lee said. "But you never get to find out whether they were, in fact, bluffing. ... We'll never know."

Sen. Ted Cruz, R-Texas, was less diplomatic in a tweet posted the day the compromise was approved: "Today, re: the so-called nuclear option, Senate Republicans preserved the right to surrender in the future."

House votes for delays on Obamacare; some Democrats give support to GOP move

The House voted Wednesday to delay mandates in the federal health care law requiring individuals and large employers to have coverage, with dozens of Democrats joining Republicans in poking a symbolic hole in the president’s signature achievement.

Both votes left Democratic leaders struggling to grapple with the health care law, which they powered through in 2010 but now are struggling to keep on track amid complaints from businesses that they are having a tough time understanding it, and fears that individuals won’t sign up.

Boxed in by what they said were Republican tricks, 35 Democrats joined with Republicans to give large businesses a one-year reprieve on following the law, helping pass that provision on a 264-161 vote. Moments later, the House voted 251-174 to give individuals the same one-year break. In that vote, 22 Democrats joined Republicans.

For every legitimate concern, there are dozens of front groups operated and funded by extremists with radical agendas. For instance, over the past several years, the ASPCA, PETA, and HSUS have been waging a war against so-called “puppy mills.”  

They lead Americans to believe that their focus is on rogue, unscrupulous dog breeders, but in a recent interview, the ASPCA admitted that they consider even law-abiding dog breeders to be “puppy mills.” Animal rights activists hold the belief that bringing new, pure-bred dogs into existence is unethical so long as there are dogs in shelters.  Thus, they seek to put every law-abiding dog breeder permanently out of business by any means necessary.

Congress readies to consider Voting Rights Act revamp

The Senate Judiciary Committee on Wednesday held the first of what could be dozens of congressional hearings to determine which states, if any, need federal oversight of their elections after the high court rejected the previous list.
A House judiciary subcommittee is scheduled to hold a similar hearing Thursday.

The Senate hearing didn’t produce potential solutions, instead serving as a warm-up to a congressional debate that could last years.

“Voting discrimination still exists; no one doubts that,” said Judiciary Committee Chairman Patrick Leahy, D-Vt. “The Supreme Court has called on Congress to come together to update the Voting Rights Act to meet current conditions, and it is up to us to meet that challenge.”

GOP to confirm 7, Obama to change 2 in deal averting 'nuclear option'

GOP senators agreed to drop their filibusters against Richard Cordray, nominated to head the Consumer Financial Protection Bureau; Thomas Perez, Obama's nominee for Labor secretary; and Gina McCarthy, who is to lead the Environmental Protection Agency, among others. In exchange, Senate Democrats and the Obama administration agreed to replace the two National Labor Relations Board members that the president appointed during a disputed Senate recess with new nominees who are to be fast-tracked.

The lynchpin of the agreement, expected to be completed and announced Tuesday afternoon, was a joint Democratic-Republican decision to put off any attempt to permanently resolve the conflict that led them to the confrontation. Under this accord, Republicans retain the right to filibuster future Obama nominees, and Democrats maintain the threat to curb the use of filibusters if they judge any GOP blockade to be unreasonable or unwarranted.

Does “We The People” still Represent Political Power?

Our Constitution begins with those words saying that the people of the United States do ordain and establish the Constitution. It does not say “We the State Legislatures” or “we the politicians” or “we a handful of important people”. A little reading of history tells us that the Constitution was conceived and written by people acting without the consent of a legislative body and then when written the Constitution was ratified by a vote of the people of each state and not the state legislators.

Clearly our entire federal government is a concept developed and established by the people of the time. The question I ask here is “Does this enormous power of the people to control their own lives still exist and if so how can it be utilized?” Have we irretrievably given this power to federal and state representatives?

Perry Signs Abortion Bill Into Law

With a few dozen protesters chanting outside and a Capitol auditorium full of supporters on hand, Gov. Rick Perry signed House Bill 2 — the omnibus abortion legislation — into law Thursday morning.

The signing occurred in a ceremony open to members of the media and invited bill supporters — both legislators and lobbyists. The group included several Republican state legislators and Democratic Sen. Eddie Lucio Jr. of Brownsville, who was the only senator from his party to vote for the bill.

“This is a bill that protects unborn babies after the fifth month of a pregnancy,” Perry said, calling HB 2 “reasonable” and “common sense.”

Taxpayer-funded CSCOPE lesson plans now available for free in public domain?

A few weeks ago we asked the question if CSCOPE lesson plans were truly gone or gone into hiding? The State Board of Education meeting currently underway in Austin appears to be answering that question by revealing CSCOPE lesson plans were merely hiding – in fact, hiding in plain sight as they are now alleged to be in the public domain and, per Texas Education Agency attorney David Anderson, with “no statute” that would require districts to refrain from using CSCOPE.

Texas sees promotion dollars, education efforts increase as Obamacare enrollment nears

New federal dollars are headed for Texas as the Health Resources and Services Administration (HRSA), a division of the U.S. Department of Health and Human Services, has awarded 66 health centers funds totaling $9,907,738 to enroll uninsured Texans in new health coverage options made available by the Affordable Care Act. These funds are a portion of $150 million in grants awarded to 1,159 health centers across the nation and part of a larger multi-front effort to promote Obamacare participation as the Oct. 1 enrollment launch date approaches.

TEA Party Caucus Advisory Committee Update

Texas Legislators:

During the entire 83rd legislation session - regular and special - we've been repeatedly crystal clear (in writing) on what we do and do not support regarding transportation funding; however, just so everybody knows we are still watching votes, I reiterate our position:

1) We view the 24% increase in session-to-session GR/ESF spending to be excessive and more than sufficient to have funded transportation and water without another raid on the ESF.  Reckless spending decisions have consequences.  To deliver baseline budgets out of the House Appropriation and Senate Finance Committees without properly funding transportation as a core constitutional function of state government was a big red flag to us that the legislature was on a spending binge.  The budget passed certainly proved our prognostication to be true. Thank you to those of you who voted against the budget.  To those of you who did not, please don't compound that bad decision by supporting a vote to raid the ESF with no protections for that fund!

2) We do NOT support any bill for transportation that does not protect the ESF. It is a commonsense safeguard to stop funding diversions if the ESF balance falls below a minimum threshold.  The ESF should always maintain a balance that will ensure the state's AAA credit rating.  The ESF should always maintain a balance to cover a true emergency due to a downturn in the economy.  The ESF was never instituted by the People of Texas to cover reckless fiscal policy and an emergency created by undisciplined elected officials so shortsighted as to jeopardize our state's fiscal health because they were willing to hang all our tomorrows on the very volatile oil and gas industry and just keep spending like there's no tomorrow.

3) We do NOT support any bill that dedicates existing sales and use taxes on vehicles to fund corporate welfare/taxpayer-subsidized profits for toll companies, the associated P3/CDA funding schemes, and to leverage more road debt.  We do not support a dedication of this revenue stream to light rail/trolley car/transit boondoggles.  We will only support a clean bill that gets us back to "pay as you go" to the highway fund for non-tolled roads. For all the people who keep saying that our goal is not possible -- they are the same people who refuse to hold TxDOT and the wasteful regional mobility authorities accountable for the flagrant examples of waste that we and other conservative activists have brought forward.

Make no mistake, a vote to raid the ESF with no protections and a vote to dedicate our tax dollars to fund more creative financing schemes that undermine the sovereignty of Texas will be considered the same as a vote to increase taxes.

Gov. Perry to Sign Texas' 20-Week Abortion Ban into Law on Thursday

Texas Gov. Rick Perry will be signing House Bill 2 into law at the state capitol Thursday morning, as pro-abortion protests continue throughout the state. According to Perry, the legislation will not only protect the unborn, but it will also advance the health and safety of women in Texas.

The legislation will ban abortion in the Lone Star state after 20 weeks gestation, and require abortion facilities to meet the same safety standards as ambulatory surgical centers. The bill would also require abortionists to have admitting privileges at a local hospital located within 30 miles of the abortion clinic, and to administer RU-486 in person.

Transparency Committee Goes Behind Closed Doors

In the coming weeks, the Texas House Select Committee on Transparency in State Agency Operations will be meeting in a closed-door session to begin their witch-hunt impeachment against a university regent accused of… seeking greater transparency. And, quite possibly, looking into cases of legislative abuse or corruption. Oddly, legislators don’t want anyone asking questions about that.

According to Article 3, Section 16, of the Texas Constitution, “The sessions of each House shall be open, except the Senate when in Executive session.” Yet inexplicably the Texas House’s Rules allow committees to meet in private.

Transparency in operations might be their name, but apparently the committee isn’t going to take it as their operating imperative in the quest to silence those investigating potential corruption and fiduciary mismanagement.

Let’s be clear about the House’s witch-hunt charges.

Rep. Pitts apparently doesn't want anyone being allowed to investigate possibly unethical behavior by lawmakers and university officials...

Jim Pitts – a moderate, anti-transparency Republican who serves as Speaker Joe Straus’ chairman of the House Appropriations Committee – filed impeachment charges last month against University of Texas Regent Wallace Hall. It appears Mr. Pitts and other crony-insider legislators are very nervous about the kinds of questions Mr. Hall has been asking in his role as a regent.

Republicans Surrender

Senate Republicans, led by Mitch McConnell, have given up the filibuster for executive nominations. Under a deal struck, the Democrats will not deploy the nuclear option, but the Republicans will let the President fill a number of positions the GOP has been blocking. Among the positions will be the ever important National Labor Relations Board, which has pursued a disastrous anti-free market agenda.

As Senator Ted Cruz noted, the GOP preserved the right to surrender in the future. What he means is that the GOP folded, but kept the appearance of still having a filibuster for executive nominations in place.

Until the GOP filibusters other executive nominees the President wants. They will then either cave again or see the nuclear option then.

When the Texas State Senate passed HB2 on Friday night, banning abortions after 20 weeks (when pre-born children have been scientifically proven to feel pain) and instituting regulations on abortion facilities that will bring them up to par with other surgical centers across the state, the scene outside the Senate chamber was chaotic. Abortion rights activists had descended upon the state capitol for a protest that became about much more than just one bill. Even Occupy Austin had joined the fray for demonstrations that, as our team witnessed, went far beyond the control of Planned Parenthood and NARAL.

The crowds started gathering very early in the morning, with some people lining up for access to the Senate gallery before 5 AM. The building became a sea of orange shirts (abortion activists) and blue shirts (pro-lifers). The abortion activists had come to the capitol ready for a fight.

The 2014 race for Texas Senate District 10 is already exciting, likely due to the intense debate over the recent bill passed in the state legislature that bans abortion past 20 weeks and requires abortion clinics to have the same standards of care as other ambulatory surgery centers.

State Sen. Wendy Davis (D) was said to have become a “rising star” as a result of her “pink-sneakered” filibuster of the legislation. But will she be able to hold onto her seat if she continues her campaign for re-election?

WASHINGTON, DC -- U.S. Senator Ted Cruz (R-TX) today spoke at the Black American Leadership Alliance’s D.C. March for Jobs to address concerns with the aspect of the Gang of Eight bill that would impose a penalty on U.S. employers for hiring U.S. citizens and U.S. permanent residents.

“One of the most egregious aspects of the gang of eight bill is its intersection with Obamacare, which penalizes businesses that hire a U.S. citizen or a legal permanent resident over an illegal immigrant,” Sen. Cruz said. “This is utterly and completely indefensible. If this bill passes it will increase unemployment: it will increase African American unemployment, Hispanic unemployment, youth unemployment and even legal immigrant unemployment.”

The senator continued, “This bill most hurts those who are struggling to climb the economic ladder. We need to fix this problem, we need to fix our broken immigration system we need to secure our borders now, we need to welcome legal immigrants and we need to uphold the rule of law and the U.S. Constitution.”

Sen. Cruz presented an amendment that would have fixed this issue by defunding Obamacare until there are no more individuals with RPI status. But the Senate Democrat majority blocked his request.

He also presented several amendments that would have strengthened border security measures; reformed the high-skilled temporary worker program; modernized, streamlined and expanded legal immigration; prohibited federal, state, or local entitlement benefits for those here illegally; and ensured that those in the U.S. illegally are not given a path to citizenship. Senate Democrats refused to allow a vote on any of these amendments.

On Impeachment Probe, Committee In Uncharted Waters

A legislative committee charged with weighing the impeachment of University of Texas System Regent Wallace Hall is easing its way into a process that has relatively little historical precedent or statutory guidance.

At the end of the first special session, Speaker Joe Straus, R-San Antonio, issued a proclamation expanding the scope of the House Select Committee on Transparency in State Agency Operations to allow it to investigate whether or not articles of impeachment should be brought against Hall, an increasingly controversial figure on the UT board.

State Rep. Jim Pitts, R-Waxahachie, had filed a resolution that would have jump-started the impeachment process, but the House leadership decided to take a step back and have the committee look into the matter and decide how to proceed.

Greg Abbott officially announces he's running for Texas governor

On the anniversary of his greatest misfortune, the state attorney general proclaimed his highest ambition to serve as governor. He promised to represent average Texans, pledging a continuation of his principles on guns, grit and greatness.

“Just as I’ve been a voice for liberty and the Constitution, I’ll be a voice for you,” Abbott said.

Pro-life Victory in Texas: Senate Passes Late-Term Abortion Ban

We knew this was coming for quite some time despite vile protestations and hours-long filibusters. Fox News has the details:

The Texas Senate late Friday passed tough new abortion restrictions after weeks of protests, sending them to Gov. Rick Perry to sign into law.

The vote came after weeks of protests and rallies drew thousands to the Capitol and made Texas the focus of the national abortion debate.

Republicans used their majority to pass the bill nearly three weeks after a filibuster by Democratic Sen. Wendy Davis and an outburst by abortion-rights supporters in the Senate gallery disrupted a deadline vote.

Called back for a new special session by Perry, lawmakers took up the bill again as thousands of supporters and opponents held rallies and jammed the Capitol to testify at public hearings.

In a statement released just after the vote, Perry said, "Today the Texas Legislature took its final step in our historic effort to protect life. This legislation builds on the strong and unwavering commitment we have made to defend life and protect women's health."

Texas Legislature Passes Pro-Life Bill; Pro-Aborts Promise Challenge

The Texas State Senate followed up House passage of a pro-life bill that would ban abortion after the 20th week of pregnancy, and pro-abortion activists have promised a court battle after Gov. Rick Perry's expected signature on the new law early next week. As reported earlier by The New American, the legislature had already passed the law in late June, but Perry was prevented from signing the bill before the end of the legislature's first special session on June 25 because of the actions of a nearly lawless pro-abortion mob at the State Capitol.

A similar mob threatened proceedings on July 12, with Texas State troopers hauling away several unruly pro-abortion screamers who attempted to disrupt the debate. The Senate's Republican majority finally passed the bill just before midnight, with all but one Democrat casting their votes against the commonsense mother-and-child protection measure.

“Today the Texas Legislature took its final step in our historic effort to protect life,” announced Gov. Perry, who vowed to quickly sign the bill into law. “This legislation builds on the strong and unwavering commitment we have made to defend life and protect women's health.”

Pro-Life Texas Attorney General Greg Abbott Running for Governor

Pro-life Texas Attorney General Greg Abbott made it official today, saying he will run for governor and seek the GOP nomination to replace pro-life Governor Rick Perry, who is not planning to run again next year.

Prior to assuming the office of attorney general, Abbott was a justice on the Texas Supreme Court and was appointed by former Texas governor and President George W. Bush.

“When it comes to our freedom and our future, I will never – I will never stop fighting,” he said during an announcement in San Antonio.

Second Amendment Revoked: The Unbelievable Reason Why This Army Vet Can’t Own a Gun

An Army veteran in Texas is fighting for his Second Amendment rights after learning that a misdemeanor pot conviction from 1971 has disqualified him from ever owning a gun.

Ron Kelly, who retired from the Army in 1993 after 20 years of service, was recently turned away when he tried to buy a .22-cal rifle at a Wal-Mart in Tomball, Texas, after a computerized background check flagged the 42-year-old arrest. The story was on the front page of the Houston Chronicle on Wednesday.

Kelly said he had forgotten about his minor pot violation from high school — the federal government, on the other hand, has not.

The Army vet spent one night in jail and was given one year of probation. Though he didn’t realize it at the time, he was also apparently stripped of his Second Amendment rights for a lifetime.
