Senate votes 53-46 to stop US from joining UN Arms Trade Treaty

Posted March 25, 2013

In the last batch of amendment votes to the budget, the Senate voted on several foreign policy proposals.
Sen. James Inhofe (R-Okla.) introduced an amendment that would prevent the United States from entering into the United Nations Arms Trade Treaty in order to uphold the Second Amendment. His amendment passed on a 53-46 vote.

Republicans have been critical of President Obama’s decision to consider the treaty, although Obama has said he would not vote for anything that would violate the Second Amendment.

McCain emerges as key senator in expanding background checks

Posted March 25, 2013

Sen. John McCain (R-Ariz.) has emerged as a key player if Senate Democrats are to have any chance of passing legislation to expand background checks for private sales of firearms.

McCain and Sens. Susan Collins (R-Maine) and Dean Heller (R-Nev.) are at the top of a list of Republicans considered most likely to sign on to legislation expanding background checks after talks with Sen. Tom Coburn (R-Okla.) stalled earlier this month.

Sen. Mark Kirk (R-Ill.) has signaled he will likely support the yet-to-be-finalized proposal he negotiated with Sens. Charles Schumer (D-N.Y.) and Joe Manchin (D-W.Va.) to expand background checks to cover private gun sales, according to Senate sources.

26 Republicans Vote for Internet Sales Tax

Posted March 25, 2013

On the Republican side, perhaps the most egregious vote was the Enzi amendment to allow states to form a cartel and collect internet sales taxes for other states.  The so-called Market Fairness Act passed in the form of a second degree amendment by 75-24, with the support of 26 Republicans.  This will send the message to Harry Reid that he has more than 60 votes to pass this as a standalone bill.  In doing so, they have voted to grow government all over the country, hurt low-tax states, impose taxation without representation, saddle small businesses with collecting taxes for 10,000 distinct tax jurisdictions, and adulterate the freest most successful entity known to man.  You can read more about it here.

Here are the 26 Republicans:

US quietly frees up frozen $500 million to Palestinian Authority

Posted March 25, 2013

While Congress froze funding to the Palestinian Authority late last year, the State Department has quietly announced that nearly $500 million in aid has now been unblocked.

“To date, we have moved $295.7 million in fiscal year 2012 money… and $200 million in fiscal year 2013 assistance,” State Department spokeswoman Victoria Nuland told reporters, according to YnetNews.
The report breaks down the payments here:

The first sum comprises some $195.7 million, allocated under the 2012 fiscal year budget for USAID economic, development and humanitarian assistance, as well as a further $100 million earmarked specifically for narcotics control.

The second sum of $200 million unblocked and available to the Palestinian Authority will come under the 2013 budget and be spent for direct budget support.

Ancient History and Modern Constitutional Powers of American Sheriffs (Part 1/2)

Posted March 25, 2013

In the Colonies, the Crown established sheriffs, as done in Britain by royal decree. But, before long, the democratic process was employed to elect them. Today, they are the last bastion of popular representation in law enforcement. Ironically, it now appears that the ancient sheriff, the last representative of popular, local federalism—might be the last chance for America to retain our civil liberties before the onslaught of Leviathan—the colossus of government tyranny. This hope is best represented by the Oath Keepers, a group educating and supporting local sheriffs as defenders of our Constitution against creeping federal insurgency. Add to this the doctrine of Nullification, or refusal to apply unconstitutional laws, which sheriffs are now applying across America on various topics, such as gun regulations, and refusing federal demand for control.

This article is composed in two parts to better describe the history, function and constitutional warrant of the local, county American sheriff.

What Sequester? Federal Jobs Website Lists Thousands of Openings

Posted March 25, 2013

For all the talk about the dramatic spending cuts to hit the federal government under the bipartisan sequestration, the federal government isn’t exactly tightening its belt. According to USAJobs.gov, the job posting site for the feds, approximately 2,200 jobs listings became available during one week in March. As Eileen Ambrose reports, “Add in new postings open only to current or former federal workers, including those laid off, and the number of new openings jumps to more than 4,600.”

Ted Cruz: ‘I Can’t Control’ Feinstein’s Reaction In Gun Hearing

Posted March 25, 2013

In an interview with The Dallas Morning News published Sunday, Sen. Ted Cruz (R-TX) said his commitment to the Constitution led him to vigorously question earlier this month an assault weapons ban put forward by Sen. Dianne Feinstein (D-CA).

At a testy hearing, Feinstein snapped back at Cruz, telling the Texas Republican, "It's fine you want to lecture me on the Constitution. I appreciate it. Just know I've been here for a long time. I've passed on a number of bills. I've studied the Constitution myself. I am reasonably well educated, and I thank you for the lecture."

Asked whether, in hindsight, he would have taken a different a tack, Cruz told the Morning News, "I can’t control her reaction."

Rep. Larry Phillips' bill, HB 3391, is up for a hearing Tuesday in the House Transportation Committee (Rm. E2.012 @ 8 AM) that would give TxDOT and toll authorities a BLANK CHECK to enter into TRANS TEXAS CORRIDOR-style toll roads that hand control of at least 26 Texas roads every two years until 2017 (and expand it to any or all RAIL projects) to private, even foreign, corporations in sweetheart deals for a HALF CENTURY.

More info on these controversial contracts here.

We need Texans to do one of the following:

1) Attend the House Transportation Committee hearing Tuesday, March 26 (Rm. E2.012 - starts at 8 AM, but likely won't be heard until the afternoon) to testify against this horrible bill that will cost Texas commuters 75 cents a mile to use our public roads; OR

2) If you can't stay to testify, register against the bill at the Capitol (register AGAINST the bill on the i-Pad looking kiosks outside committee rooms); OR

3) Call the House Transportation Committee member (Capitol Switchboard is 512-463-4630) closest to your city and tell them to vote 'No on HB 3391' (more talking points below)

Rep. Larry Phillips (Sherman-Denison/Grayson Cty area) (Phillips says his constituents LOVE toll roads) - 512-463-0297
Rep. George Lavender (East Texas) - 512-463-0692
Rep. Allen Fletcher (Houston) - 512-463-0661
Rep. Debbie Riddle (Houston) - 512-463-0572
Rep. Linda Harper-Brown (Irving/North Texas) - 512-463-0641
Rep. Yvonne Davis (Dallas) - 512-463-0598
Rep. Cindy Burkett (Mesquite/North Texas) - 512-463-0464
Rep. Ruth McClendon (San Antonio) - 512-463-0708
Rep. Joe Pickett (El Paso) - 512-463-0596
Rep. Mando Martinez (Hidalgo County/the Rio Grande Valley) - 512-463-0530
Rep. Robert Guerra (Hidalgo County/the Rio Grande Valley) - 512-463-0578

; AND EMAIL the entire House Transportation Committee in one click here: house_hc@texasturf.org

Tell them "Vote 'No' on HB 3391. We do not want you to hand Texas roads to private corporations who extract exorbitant toll rates (75 cents/mile) from commuters just to get to work. Texas roads belong to Texans. It's anti-liberty and un-Texan to hand our state sovereignty over public infrastructure to private, even foreign, entities for a HALF CENTURY in sweetheart deals that guarantee profits. We don't want this authority to extend to RAIL boondoggles either!"

There are also bills to give toll authorities their OWN COURTS to be the judge & jury in cases disputing toll fines/fees that would grant them authority to block your car registration. It's the fox guarding the henhouse and eliminates any REAL due process afforded Texans in traditional courts where an unbiased third party hears the case.

HB 3048 - Also to be heard in House Transportation Committee Tuesday, Rm E2.012 @ 8 AM.

HB 1054 - (Lavender) To prohibit the conversion of a FREEway into a tollway. Removes loopholes that have plagued our state since 2003! (Will be heard in House Transportation Committee Tuesday, Rm E2.012 @ 8 AM)
SB 1029 - (Campbell) To prohibit the conversion of a FREEway into a tollway. Removes loopholes that have plagued our state since 2003! (Will be heard in Senate Transportation Committee Wednesday, Rm E1.016 @ 8 AM)
SB 1253 - (Zaffirini) To prohibit TxDOT or toll agencies from downgrading/slowing the free routes adjacent to toll lanes/toll roads. (Read why this bill is necessary here. TxDOT increased the speed limit on SH 130, the first foreign-owned toll road in TX, to 85 MPH and lowered the speed limit on adjacent Hwy 183 from 65 MPH down to 55 MPH). (Will be heard in Senate Transportation Committee Wednesday, Rm E1.016 @ 8 AM)

Bloomberg to Spend $12M to Push Gun Control

Posted March 25, 2013

“I don’t think there’s ever been an issue where the public has spoken so clearly, where Congress hasn’t eventually understood and done the right thing,” Bloomberg told David Gregory in an NBC interview to be broadcast Sunday morning. The ads Bloomberg finances are specifically directed at universal background checks, the least controversial portion of his proposed legislation – and only the first step. As Bloomberg explained, “We are going to have a vote on – for sure – on assault weapons and we’re going to have a vote on background checks …. We’ve got the plan, we’re going to get the vote.”

STEVE TOTH: Obamacare will force job cuts, bankrupt states

Posted March 25, 2013

To think that it couldn’t get any worse. Boy, were we wrong.

America’s healthcare system is not perfect. We absolutely have problems, but I would challenge anyone to show me even a close second. Stay up late some evening and watch C-SPAN cover the British Parliament as they debate their failed socialized medical system. Are we learning from Europe’s failed takeover of health care? Not a chance.

America is cramming the most successful healthcare system in the world into the Pandora’s box also known as Medicaid (talk about going from the frying pan into the fire).

First fact to consider: There are fewer and fewer doctors willing to take Medicaid patients. Buried deep in Obamacare is a provision that will push 9 million more Americans into Medicaid with no provision to increase the number of doctors able to care for them. Medicaid patients have a 50 percent “no-show” for doctor appointments across Texas. Combine the no-shows with ridiculously low compensation levels from Medicaid and you see why few doctors are willing to take Medicaid. Most doctors who take Medicaid do so in the spirit of charity, but charity only goes so far. A resident entering practice for the first time is looking at record levels of education debt and record malpractice premium rates. Simple math tells you that you can only take so many Medicaid patients and still pay the bills.

Second fact to consider is that perverse, government incentives will increase the jobless rate, forcing even more people (above the 9 million projected) into Medicaid.

Texas HCR 77 ~ A New Path to Victory

Posted March 22, 2013

I write this as a constitutional conservative for constitutional conservatives. Victory, therefore, can only be defined as the restoration of individual liberty through the smallest and least intrusive government possible. Historically and logically this requires government to be small and subject to local control. Centralizing governmental authority is antithetical to this principle and to the founders’ vision. For Texans, HCR 77 is a good first and logical step in this restorative process.

HCR 77 is simply a statement of principle. It asserts that Texans and the State of Texas reserve for themselves all the powers not specifically granted to the US federal government in the US Constitution, or prohibited to both the states and the people in the US Constitution. This is consistent with both the Tenth Amendment of the US Constitution and the Constitution of the State of Texas which was accepted and authorized by the US government as a condition of Texas’ re-entry into the Union after the Civil War.
