A federal appeals court has ruled that President Barack Obama violated the Constitution when he bypassed the Senate to fill vacancies on a labor relations panel.

The U.S. Court of Appeals for the D.C. Circuit says Obama did not have the power to make recess appointments earlier this year to the National Labor Relations Board.

Obama claims he acted properly because the Senate was away for the holidays. But the court says the Senate technically stayed in session when lawmakers gaveled in and out every few days for so-called "pro forma" sessions.

GOP lawmakers used the tactic specifically to prevent Obama from using his recess power to fill vacancies in an agency they claimed was too pro-union.

The Obama administration is expected to appeal the decision to the Supreme Court.


NRA boycott kills outdoors show that banned assault weapons

A massive boycott backed by the NRA and
outdoorsmen and women outraged that the nation's largest outdoors show banned the exhibition of assault weapons has caused the show's organizers to abruptly cancel the week-long event in Harrisburg, Pa.

The successful boycott, started by the website mynortheastoutdoors.com, was the biggest demonstration of support by the outdoors industry yet against gun control efforts being pushed in Washington and in several states.

"Reed Exhibitions has decided to postpone, for now, the Eastern Sports and Outdoor Show given the controversy surrounding its decision to limit the sale or display of modern sporting rifles (also called ARs) at the event. The show was scheduled to take place February 2-10 in Harrisburg, Pa.," the organizer said in a statement Thursday.

If you’ve never heard of Common Core (relabeled the “Common Core Georgia Performance Standards” in Georgia), it’s a nationwide initiative designed to herd states into national K-12 standards and national tests – which ultimately will lead to a national curriculum and silence curriculum input from local parents, taxpayers, and educators.

Proponents insist that the Common Core initiative is “state-led” and “voluntary,” and that the national standards are “rigorous,” “internationally benchmarked,” and designed to make our students “college-and career-ready.” They also insist that Georgia is not relinquishing control over its standards and curriculum by adopting Common Core, and that the federal government is not controlling this effort. There are several questions that seem to come up regularly regarding Texas independence. Here is a compilation of those questions and the answers to them.

Can Texas actually secede? 

The definition of “secede” is as follows: “To withdraw formally from membership in a federal union, an alliance, or a political or religious organization.” Secession is a very general term to describe a wide range of processes to achieve autonomy and self-government within a political or social context. The question then, really, is there any path for Texas to achieve autonomy and self-government? The paths are endless.

As Senate Democrats unveiled an “assault weapons ban” encompassing a variety of rifles, shotguns, and pistols, the newest lawyer in the U.S.

Senate pointed out that “real assault weapons” have been illegal since 1934. “Washington politicians shouldn’t be taking advantage of recent
tragedy to try to push an aggressive gun control agenda,” said Sen. Ted Cruz, R-Texas, in a statement today. “Real assault weapons—machine guns—are already functionally illegal, and they have been since 1934. This proposal would have done nothing to prevent the terrible murders in Newtown, but it would limit the constitutional liberties of law-abiding citizens.”


Web of environmental rules threatens Gulf Coast businesses with jail, steep fines

When Burt Rico was caught using a deer feeder equipped with lights while hunting in Louisiana, he was slapped with a $1,051 fine and sentenced to 60 days in jail. He was cited for hunting without a big-game license, failing to wear hunter orange and hunting deer with an artificial light. 

Until he was cited, he didn’t know he had done anything wrong, he claims.  

Rico’s case isn’t an isolated one. According to a new report by the Texas Public Policy Foundation, thousands of people are being prosecuted for environmental crimes every day they didn’t know were even on the books. They’ve been threatened, fined and thrown in jail. The trend is especially prominent along the Gulf Coast, but is becoming a national issue.

Democrats launch plan to turn Texas blue

National Democrats are taking steps to create a large-scale independent group aimed at turning traditionally conservative Texas into a prime electoral battleground, crafting a new initiative to identify and mobilize progressive voters in the rapidly-changing state, strategists familiar with the plans told POLITICO.

The organization, dubbed “Battleground Texas,” plans to engage the state’s rapidly growing Latino population, as well as African-American voters and other Democratic-leaning constituencies that have been underrepresented at the ballot box in recent cycles. Two sources said the contemplated budget would run into the tens of millions of dollars over several years - a project Democrats hope has enough heft to help turn what has long been an electoral pipe dream into reality.
